These Terms & Conditions (“Terms”) are a legally binding agreement between you (“you” or “your”) and Kenwood Design LLC, doing business as Kenwood Home (“Kenwood Home,” “Company,” “we,” “us,” or “our”), regarding your access to and use of www.kenwoodhome.com (the “Site”) and any related products, services, scheduling, online purchases, and digital materials offered through the Site (collectively, the “Services”).

By accessing the Site, booking an appointment, purchasing Services, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Site or purchase Services.

1) Eligibility

The Services are intended for individuals who are 18 years of age or older. By using the Services, you represent that you are at least 18 and have the legal capacity to enter into these Terms.

2) Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

3) Our Services and General Information

The Site may include design-related information, recommendations, and inspiration. While we strive to provide helpful and accurate information, the Site and Services are provided for informational purposes and do not constitute legal, engineering, architectural, structural, or other licensed professional advice.

4) Design Services Scope (Design Guidance Only)

Kenwood Home provides design guidance and consulting. Unless otherwise agreed in writing, our Services are limited to recommendations, planning support, and curated guidance, which may include (as applicable): space planning guidance, finish selections, styling suggestions, furniture guidance, and visual support.

Client execution responsibility

You understand and agree that you are responsible for:

  • Ordering/purchasing products and materials

  • Verifying dimensions, measurements, clearances, and fit

  • Hiring and managing contractors or trades

  • Scheduling, installation, construction, and execution

  • Permits, inspections, and compliance with applicable laws/codes

We do not provide contractor management, project management, procurement management, or installation services unless explicitly stated in writing.

Measurements and site conditions

You are responsible for ensuring measurements and site information are accurate before purchasing or installing any items. If measurements or information provided by you are inaccurate or incomplete, you assume all resulting risk and costs.

No code/permit/engineering responsibility

We are not responsible for building codes, permitting, zoning, structural engineering, mechanical systems, electrical, plumbing, safety standards, or ADA compliance. You are responsible for consulting licensed professionals as needed.

Product availability and third-party performance

Products and materials are subject to availability, lead times, discontinued items, substitutions, and manufacturer changes. We do not guarantee product availability, pricing, lead times, performance, or outcomes, and we are not responsible for third-party vendor, shipping, delivery, or contractor performance.

5) Purchases, Payments, and Checkout

Purchases may be processed through Squarespace Commerce and/or Squarespace Payments. Prices are listed in U.S. dollars (USD) unless otherwise stated.

You agree to provide current, complete, and accurate purchase information. We reserve the right to:

  • Correct pricing errors or inaccuracies

  • Refuse or cancel orders at our sole discretion

  • Modify, discontinue, or limit Services or offerings at any time

Payment processing

Payments are processed by third-party providers (including Squarespace Payments and its service providers). Kenwood Home does not store or have access to your full payment card details.

Taxes

Sales tax may be added where required. Third-party processors may support automated tax calculations. You are responsible for any applicable taxes not collected at checkout.

6) Refunds, Cancellations, No-Shows, and Rescheduling

Design Packages (Services)

Because design services reserve time and involve custom work:

  • Payments are non-refundable once work has begun, including any prep, review, concept development, sourcing, drafting, or creation of recommendations/visuals/deliverables.

  • If you cancel before work begins, we may (at our discretion) issue a partial refund minus an administrative fee or offer a credit toward future services.

Consultations

Consultations reserve a time slot:

  • Consultation fees are non-refundable.

  • You may request to reschedule with reasonable notice. Late cancellations or no-shows may forfeit the fee.

Rescheduling

We reserve the right to charge additional fees for repeated reschedules or short-notice changes.

Chargebacks

If you initiate a chargeback or payment dispute, we reserve the right to suspend delivery of Services and/or deliverables until the dispute is resolved. You agree to contact us at abby@kenwoodhome.com first to attempt informal resolution.

7) Client Responsibilities

To help ensure efficient and accurate guidance, you agree to:

  • Provide timely, accurate information (photos, measurements, inspiration, constraints)

  • Communicate promptly about budget, goals, and priorities

  • Verify measurements, order details, and installation requirements before purchase/execution

  • Consult licensed professionals for construction, structural changes, and code compliance

8) Intellectual Property

Our Site content

All content on the Site—including text, graphics, photos, design boards, layouts, visuals, renderings, templates, and downloadable materials—belongs to Kenwood Home or our licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, publicly display, publish, create derivative works from, or commercially exploit Site content without our prior written permission.

Design deliverables

Any design deliverables we create (including concepts, mood boards, 3D visuals, layouts, plans, documents, and curated selections/links) remain our intellectual property unless otherwise agreed in writing.

You receive a limited, non-transferable license to use deliverables for your personal residential project only. You may not resell, publish, share, distribute, post online, or reuse deliverables for commercial purposes (including by contractors, builders, other designers, or third parties) without written permission.

9) Client Materials and Permissions

You may provide images, measurements, inspiration, and other materials (“Client Materials”). You represent you have the right to share them.

Unless you opt out in writing, you grant Kenwood Home permission to use non-sensitive project materials (such as general before/after photos or broad project descriptions) for portfolio and marketing purposes, without sharing confidential personal details. If you prefer not to grant this permission, email abby@kenwoodhome.com.

10) Third-Party Links and Tools

The Site may contain links to third-party websites, products, services, or tools. We are not responsible for third-party content, availability, pricing, policies, practices, or performance. Use third-party sites and products at your own risk.

11) Affiliate Links and Sponsored Content

Some links on this website may be affiliate links. This means that if you click on a link and make a purchase, Kenwood Home may earn a small commission at no additional cost to you.

Affiliate links may appear within:

  • Blog posts

  • Design recommendations

  • Product roundups

  • Shop or inspiration pages

  • Emails or digital materials

We only share products, brands, or resources that we genuinely use, recommend, or believe may be helpful. Any compensation received through affiliate links does not influence the price you pay.

Kenwood Home does not guarantee product availability, pricing, performance, delivery timelines, or outcomes related to third-party products or services purchased through affiliate links. All purchases made through affiliate links are subject to the policies and customer service practices of the third-party seller.

Participation in affiliate programs does not constitute an endorsement or warranty of any third-party product, service, or vendor.

12) Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose

  • Attempt to hack, disrupt, scrape, crawl, or reverse engineer the Site

  • Upload malicious code or interfere with Site security

  • Post false, abusive, defamatory, or harmful content

  • Misrepresent your identity or affiliation

We may suspend or terminate access for violations.

14) Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee specific outcomes, savings, increased home value, contractor performance, product performance, timelines, or satisfaction.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KENWOOD HOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

IN ANY EVENT, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16) Indemnification

You agree to indemnify, defend, and hold harmless Kenwood Home and its owners, contractors, affiliates, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your breach of these Terms

  • Your misuse of the Site or Services

  • Your purchases, installations, contractor work, or project execution

  • Your violation of law or third-party rights

  • Your Client Materials and any claims related to them

17) Termination

We may suspend or terminate your access to the Site or Services at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to our business, operations, reputation, or other users.

18) Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules.

19) Dispute Resolution (Binding Arbitration; Class Action Waiver)

Informal resolution first

Before initiating arbitration, you agree to contact us at abby@kenwoodhome.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration

If the dispute cannot be resolved informally, you and Kenwood Home agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, rather than in court, except as noted under “Exceptions” below.

Arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules (including consumer rules when applicable). The arbitration may be conducted remotely (by video/phone) unless the arbitrator requires otherwise. The arbitrator may award the same damages and relief as a court.

Class action waiver

YOU AND KENWOOD HOME AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions

Either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized use or misuse of the Services. For those limited purposes, venue will be in Minnesota as set forth below.

Venue fallback

If a court determines that a claim must proceed in court rather than arbitration, you agree that it will be brought exclusively in the state or federal courts located in Minnesota, and you consent to jurisdiction and venue there.

20) Electronic Communications and Signatures

By using the Services, you consent to receive communications electronically (including email and website notices). You agree that electronic agreements, notices, disclosures, and records satisfy legal requirements for written communications.
